Introduction

Maximum Technologies, Inc. (“Maximum”) understands and respects your privacy and is committed to protecting any personal information shared with us.

This Privacy Policy describes how we collect, use, secure, and where applicable, share information when you visit www.maximum.com and any of our other websites (collectively, the “Website”), and summarizes your privacy rights.

Scope

Given the nature of Maximum’s business and the customers we work with, the Privacy Policy may be applied differently depending on your interactions with Maximum and the Website. The scope of the Privacy Policy is dependent on the role Maximum plays in each instance. It’s important to define two key terms to better understand which party is responsible for making the decisions about your data that may be shared.

A Data Controller/Business is the party that decides what information gets collected and what happens to it. A Service Provider/Data Processor is a third-party (in this case, Maximum) who is hired to handle information on someone else’s behalf and only does what that other party (in this case, your financial institution) instructs.

For all Website visitors, the Privacy Policy applies to information collected through the Website and any related marketing communications. In this instance, Maximum is acting as a Data Controller/Business.

If you are the customer of a financial institution that is a customer of Maximum and uses our software, then your privacy rights are subject to your financial institution’s privacy policy and related procedures and standards. Given your relationship is with your financial institution and not Maximum, this Privacy Policy does not apply to the information you share with your financial institution. In that instance, Maximum is acting as a Service Provider/Data Processor. Your financial institution is the Data Controller/Business.

It is important to note that when Maximum acts as a Service Provider/Data Processor for your financial institution, we are unable to process your data rights requests. As noted above, since your data is held by your financial institution, only they can fulfill your request. In such cases, please contact the financial institution where the account or data in question is maintained.

There are instances where you may access Maximum content through third-party platforms such as social networking sites. This Privacy Policy does not apply to information collected on those platforms. If you have any questions about how your data is handled by those platforms, you will have to consult their respective privacy policies. In the event that we receive any of your data from a third-party, this Privacy Policy will then apply to your data.

How to Exercise your Rights

When Maximum acts as a Data Controller/Business, you can submit a data rights request directly to Maximum at privacy@maximum.com.

Response Timing and Verification

Once we verify your request, we strive to respond within 30 business days of receiving your verified request. If more time is required, we will let you know why, and how much longer we need to respond to your request.

Please note that we must verify your identity before we can act upon your request. To process your request, we must be able to match your identifying information, such as your name and email address, to our records. There may be instances where we require additional information to confirm your identity. If another party is acting on your behalf, we will need written legal authorization clearly indicating that that party is duly authorized to act on your behalf.

If we deem it necessary to deny your request, you have the right to appeal by contacting us at privacy@maximum.com. The appeal must be made within 30 business days from the date of our decision.

As a reminder, in the instances where we are acting as a Service Provider/Data Processor for your financial institution, we will not be able to process any data rights requests from you. Contact your financial institution with any and all such requests.

Information We Collect

When interacting with Maximum through the Website, the information you provide may include:

• Personal Identifiers — These include your name, email, address and phone number
• Professional Information — This may include your company name and job title
• Communications — There may be instances where you provide us with feedback, or submit a request for technical or product support

IMPORTANT NOTE: We do not collect sensitive personal information (e.g. Social Security Number, biometrics, etc.) through the Website. We will never ask you for such information through the Website and you should never provide sensitive personal information through the Website via any method.

Information Collected Automatically

Within the Website, we use standard cookies and other tracking technologies. In doing so, we may collect device data such as IP address, browser type, operating system and device type. We may also collect information about your usage of the Website that includes the pages you visited, how much time you spent on those pages, and the URL of any site that referred you to our page. We may also collect general location information based on IP address.

How We Use Your Information

In instances where we do use your personal information, we will only use it for the following business purposes:

• To provide you with content, documents or product information you requested
• To monitor Website traffic, ensure the security of the Website and prevent fraud
• To market our products and services (with your consent, where required)
• To analyze Website usage so that we may better engage with our audience and improve the overall user experience and interface

From time to time, we will need to comply with subpoenas, court orders, regulatory requirements and requests and other mandatory requests.

Please note that we only retain personal information for the amount of time that it is reasonably necessary to fulfill the business purposes for which it was collected and to satisfy legal, regulatory, accounting or other requirements.

How We Share Your Information

Below are the circumstances in which we may share information:

• Maximum works with third-party service providers who, among other things, host the Website, communicate with existing and prospective customers, host our data environment and provide other services. It’s important to note that each and every one of these third-parties is legally and contractually required to keep all information and data strictly confidential.
• Maximum may share information with subsidiaries and affiliates for internal business purposes, such as accounting, marketing and sales opportunities and other administrative purposes.
• If Maximum receives a subpoena or court order, it is legally required to provide responsive information to the requesting authority.
• If Maximum engages in corporate activity such as a merger, acquisition or sale of assets, the transfer of data and information may be required.

Cookies and Tracking Technologies

As is the case with almost all websites, the Website uses cookies to enhance your user experience and functionality. There are two types of cookies. Essential Cookies are necessary for the website to function in all instances. You are not able to opt out of Essential Cookies. Analytics/Marketing Cookies are cookies that are used to analyze performance and deliver advertising. These are considered Non-Essential Cookies. Your Privacy Options

You may opt out of the sale or sharing of your personal information, to the extent that we ever do so. You can opt out by emailing privacy@maximum.com.

We recognize opt-out preference signals, including the Global Privacy Control (GPC). When we detect a GPC signal from your browser or device, we treat it as a valid request to opt out of the sale or sharing of personal information and of cross-context behavioral advertising for that browser or device. Because these signals operate at the browser or device level and may not be linked to any account, you may need to enable the signal separately on each browser and device you use, and you may need to re-enable it if you clear your cookies.

You can manage non-essential cookies through our Cookie Preferences tool and your browser settings. Essential cookies are required for the Website to operate and cannot be disabled.

Security

We use industry-standard physical, technical, and administrative safeguards (such as encryption and firewalls) to protect your personal information. However, it is important to note that despite our best efforts, no method of transmitting information over the internet is completely secure.

Children’s Privacy

The Website and Maximum’s activities are exclusively intended for business and institutional use and is not intended for children under the age of 18. We never knowingly collect personal information from children. Any information inadvertently collected will be deleted.

California Privacy Notice

Maximum does not currently meet the thresholds that make it a “business” subject to the California Consumer Privacy Act (CCPA) with respect to information collected through the Website. If that changes, we will update this Policy and provide the disclosures and rights the CCPA requires. Where Maximum processes personal information on behalf of a financial institution, that institution is the “business” under the CCPA and is responsible for responding to consumer-rights requests.

Changes to the Privacy Policy

The Privacy Policy may be updated from time to time to reflect changes in our practices, technology, legal requirements, or other factors. When we make changes, we will revise the “Last Updated” date at the top of this Privacy Policy. As with all of Maximum’s terms, notices and disclosures, we encourage you to review this Privacy Policy periodically. Each use of the Website constitutes your acceptance of the Privacy Policy in effect at the time.
